Terms of Service

This is a pre-launch version; these terms will be reviewed by counsel before public launch.

These Terms are the agreement between you and Volumatrix LLC for using actual.love. We have tried to keep them readable. Please read them before you sign up, and especially before you buy a membership.

1. About these Terms#

actual.love (the "Service") is operated by Volumatrix LLC, a Wyoming limited liability company ("Volumatrix", "we", "us", "our"). By creating an account, starting an interview, buying a membership or otherwise using the Service, you agree to these Terms and to the policies they refer to: the Privacy Policy, the Community Guidelines & Safety, the Subscription, Auto-renewal & Refund terms and the Cookies notice. If you do not agree, please do not use the Service.

2. Who the service is for#

actual.love is for adults seeking a committed, lifelong relationship, not hook-ups or one-night stands. It introduces members of any gender to each other when each is looking for the other, currently only in the Los Angeles area (about 80 km around downtown Los Angeles).

Before your call you tell us your own gender and who you would like to meet. We introduce you only to members of the gender you are seeking who are, in turn, seeking someone of your gender. Anyone may join and talk with Valeria for free, wherever they live. If introductions are not yet available in your area, you are on our free waitlist: you will never be charged, and we will let you know if that changes.

To use the Service you must:

• be at least 18 years old and able to enter into a binding contract;
• give your real date of birth at signup (accounts that appear to belong to someone under 18 are suspended);
• be genuinely looking for a committed relationship, and not be married or otherwise committed while presenting yourself as single;
• not have had an account removed by us before, unless we have told you in writing that you may return.

3. Your account#

• Starting without an account. You can start a call with Valeria without an account after giving your first name, your gender and who you would like to meet, and confirming that you are 18 or older, that you understand the call is with an AI over video, and that you accept these Terms and the Privacy Policy. After 3 minutes, continuing requires a free account (email, password, date of birth, city, your consent to visual compatibility and, optionally, marketing emails). Your conversation so far is then attached to your new account. If you never create an account, the data from your guest call is deleted after 7 days.
• Give accurate information about yourself and keep it up to date. One person, one account.
• Keep your password private. You are responsible for activity on your account. If you think someone else has access, tell us at safety@actual.love.
• Your account is personal. You may not sell, transfer or share it.

4. Valeria, your AI matchmaker#

• The interview is a video call. You speak with Valeria, and your camera is on during the call so she can see you and respond naturally. Your browser will ask for permission to use your microphone (required for the call) and your camera (required for the video interview). You can mute or turn off your camera at any time, and the call ends when you leave.
• How the call is processed. During the call, your audio and camera video (roughly one frame per second) are transmitted in real time to Google's Gemini API so Valeria can hear, see and reply. Google acts as Volumatrix's service provider under a data processing agreement, and we use Google's paid API tier, under which Google does not use this data to train its models.
• No recording. We do not record or store the audio or video of your call. We do store a text transcript of the conversation, linked to your account and encrypted at rest.
• Call time. Free calls are limited to 20 minutes in total, which is enough for your interview. Members can call for up to 45 minutes per call and 90 minutes per day.
• Limits. Valeria can misunderstand you, forget things or be wrong. She is not a therapist, counselor, doctor or human matchmaker, and she does not replace professional help. Nothing she says is professional advice. If you are in crisis or in danger, contact your local emergency services.
• Your wellbeing. Valeria is an AI companion chatbot and may not be suitable for some minors; actual.love is only for adults 18 and over. If you mention thoughts of suicide or self-harm, Valeria will respond with care and refer you to the 988 Suicide & Crisis Lifeline (call or text 988) and, in an emergency, to 911. Our crisis protocol is published on Valeria and your wellbeing.

5. How matching works#

Your matchmaking profile

From your interview transcript, an AI builds a private matchmaking profile: your values, interests, lifestyle, what you are looking for, your dealbreakers and preferences, and a short summary. Your answers to follow-up surveys are added to it. You can view it, correct it and delete it at any time.

Visual compatibility

People tend to be happiest with partners they find attractive and who find them attractive in return. So, only with your express consent and only if you are eligible for introductions in the Los Angeles area, a few still frames from your interview are analysed by an AI model to produce an internal estimate of how you present visually. It is never run for people on the waitlist, whether they are outside our area or waitlisted for any other reason. We use it for one thing only: to suggest introductions between people who are likely to find each other mutually attractive, so that people are matched within a similar range.

• You give this consent with a separate checkbox at signup. It is required to use matching, because matching depends on it.
• The estimate is never shown to other members and never sold. It is included in your own data export (Account → Privacy → Download my data).
• It is not used to identify you. We do not create face templates or use facial recognition. An AI model reviews the frames once and returns only a number.
• The frames are discarded immediately after analysis; they are not stored. The numeric estimate is stored encrypted and is deleted with your account.
• You can withdraw this consent at any time in Settings. Withdrawing deletes the estimate and pauses new introductions.

Introductions

• We tell you that Valeria has found you a match only when she has found a real, active member who is available for an introduction.
• Matching is automated. The AI considers compatibility (values, intent, lifestyle, dealbreakers, location and age preferences) together with visual compatibility. You receive one introduction at a time, and only for a good match (an internal score of 70 out of 100 or more).
• An introduction shows the other person's first name, age and area, Valeria's reason for the match and a short summary. Each person has 24 hours to answer; an introduction that is not answered in time expires.
• Both people must say yes before any contact details are exchanged (see Section 7).
• Because introductions are decided automatically, you can ask for a human to review a decision that affects you by writing to privacy@actual.love. The Privacy Policy explains the logic in more detail.
• We do not guarantee any number of introductions, that anyone will say yes, or any outcome. Matching depends on who else is a member, where they live and what they are looking for.

Follow-up survey

About 7 days after you exchange contact details, we email each of you a private link to a short survey: how you rate the match (1 to 5), whether you met, whether you want to keep seeing each other, what you liked or what wasn't right, and what actual.love could do better. Your answers are stored in your encrypted matchmaking profile and used only to improve your future matches and the Service. If either of you says you do not want to continue, the introduction closes and matching resumes. If you both want to continue, your searches pause.

6. Photos#

actual.love has no public photos. Once an introduction is made, each of you may upload a photo for that introduction and choose whether to share it. Photos are shown only if both of you choose to share (a mutual exchange). A photo is served only to the two people in the introduction (and to our staff for safety review), and is deleted with your account. Your photo must be a genuine, recent photo of you, and must follow the Community Guidelines. If an intimate image of you has been shared without your consent, you can ask us to remove it through our image removal form; we remove it within 48 hours of a valid request.

7. Saying yes and exchanging contact details#

• To say yes to an introduction, you choose at least one contact detail to share: your phone number, your WhatsApp number and/or your email.
• Only when both of you say yes does each of you see the contact details the other chose. That exchange is the connection actual.love makes.
• actual.love has no in-app chat and no video dates. After the exchange, you talk and meet using your own phone, WhatsApp or email. We do not see, track or keep any messages or calls between you, and we cannot moderate them.
• Use the contact details you receive only to get to know that person, and do not share them with anyone else.

8. Membership, payments and auto-renewal#

Your interview with Valeria (up to 20 minutes of calls in total) and her search are free, with no card, until Valeria has found a match for you with a real, active member who is available for an introduction. We tell you when she has, and you can see the introduction (first name, age, area, Valeria's reason and a summary). To say yes to it and continue, including further calls with Valeria and new introductions, you need a paid membership. You are never charged automatically; nothing is charged unless you choose one: Monthly at US$9 per month or Annual at US$99 per year, plus any applicable taxes. People on the free waitlist (see Section 2) are never charged. Payments are processed by Stripe; we do not store card numbers.

Plans are month-to-month or 12 months; we never sell a membership longer than 12 months. Before you pay, we ask you to agree to automatic renewal with a separate checkbox, which is not ticked in advance.

Memberships renew automatically at the end of each period, and your payment method is charged the then-current price, until you cancel. You can cancel at any time online under Account → Membership → Cancel membership; cancellation takes effect at the end of your current period. You may cancel within 3 business days of purchase for a full refund (see the notice at the top of these Terms), and refunds also apply in the case of death or disability or if you move away from our service area (details). Otherwise, refunds for partial periods are not provided except where the law requires them. The full terms, including the EU/UK withdrawal right and US auto-renewal disclosures, are in our Subscription, Auto-renewal & Refund terms, which form part of these Terms.

9. How you must behave#

You agree to follow the Community Guidelines. In particular, you must not:

• use the Service if you are under 18, or involve anyone under 18;
• offer, request or promote sex work or any kind of sexual solicitation;
• run scams, ask for money or financial help, or promote anything commercial;
• harass, threaten, stalk, demean or abuse anyone, or post hateful content;
• impersonate anyone or misrepresent who you are, including being married or in a relationship while presenting yourself as single;
• share another member's contact details, photos or other personal information;
• scrape, copy, reverse-engineer or overload the Service, use bots or automated access, or try to manipulate Valeria or our AI systems to get around safety measures;
• break any law.

10. Reports and enforcement#

You can report an introduction or a member at any time from the introduction card. Our staff review reports. We may remove photos, end introductions, and suspend or close accounts that break these Terms or the Community Guidelines, or that we reasonably believe put others at risk. Where appropriate we may share information with law enforcement, as described in the Privacy Policy. If you think we made a mistake, write to safety@actual.love.

12. Your content#

You own what you say and share on the Service. You give Volumatrix a worldwide, non-exclusive, royalty-free licence to host, store, transcribe, analyse and process your content (including creating your matchmaking profile and showing the photo and contact details you choose to share to the person you are introduced to) only as needed to provide, secure and support the Service, as described in the Privacy Policy. This licence ends when your content is deleted, except for copies we must keep for safety or legal reasons as set out in the Privacy Policy. You confirm that you have the right to share what you share.

13. Our property#

The Service, Valeria, the avatar, our software, designs, text and trademarks (including "actual.love", "Valeria" and "Volumatrix") belong to Volumatrix or its licensors. We give you a personal, limited, non-transferable, revocable licence to use the Service for its intended, non-commercial purpose under these Terms. If you send us feedback, we may use it without obligation to you.

14. Services we rely on#

The Service depends on third parties, including Google (the Gemini API), Stripe (payments), Moholo avatar technology (loaded from moholo.ai) and OpenStreetMap Nominatim (turning your city into approximate coordinates). We choose them carefully but are not responsible for outages or changes outside our control. Stripe Checkout and the Stripe billing portal are also subject to Stripe's own terms.

15. Ending your account#

• You can delete your account at any time under Account → Privacy → Delete account. Deletion is immediate. Deleting your account cancels your membership immediately, and you will not be charged again. You can also cancel your membership without deleting your account under Account → Membership → Cancel membership.
• We may suspend or close your account if you break these Terms, if your account appears to belong to someone under 18, if we are required to by law, or to protect other members. Where it is safe and lawful, we will tell you why.
• Sections 11, 12 (for copies we are allowed to keep), 13, 16, 17, 18, 19, 20 and 21 continue after your account ends.

16. Disclaimers#

TO THE EXTENT PERMITTED BY LAW, THE SERVICE, VALERIA AND ALL INTRODUCTIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND UNINTERRUPTED OR ERROR-FREE OPERATION. AI SYSTEMS MAKE MISTAKES. WE DO NOT WARRANT THE IDENTITY, CONDUCT, INTENTIONS OR COMPATIBILITY OF ANY MEMBER, OR THAT YOU WILL FIND A PARTNER. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

17. Limitation of liability#

TO THE FULLEST EXTENT PERMITTED BY LAW, VOLUMATRIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM THE CONDUCT OF ANY MEMBER OR THIRD PARTY, ONLINE OR OFFLINE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (B) US$100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence, for fraud, or, for consumers in the EU and UK, your statutory rights.

18. Indemnity#

To the extent permitted by law, you will indemnify Volumatrix against claims, losses and reasonable legal costs arising from your breach of these Terms, your content, or your conduct towards other members. This does not apply to consumers in jurisdictions where such indemnities are not permitted.

19. Governing law#

These Terms are governed by the laws of the State of Wyoming, USA, and applicable US federal law, without regard to conflict-of-law rules. Subject to Section 20, the state and federal courts located in Wyoming have exclusive jurisdiction. If you live in California (or another US state whose consumer-protection laws cannot be waived), nothing in this section takes away the rights those laws give you, including your rights under California's dating service contract law (Civil Code §1694 and following), its automatic renewal law and its civil rights laws.

20. Dispute resolution: arbitration and class-action waiver (US members)#

This section applies if you live in the United States. Please read it carefully; it affects your rights.

• Talk to us first. Before bringing a claim, email support@actual.love with the subject "Legal dispute", your name, your account email and a description of the problem. We will both try in good faith to resolve it for 60 days.
• Binding individual arbitration. Any dispute arising from or relating to these Terms or the Service that we cannot resolve informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may instead bring an individual claim in small-claims court, and either of us may seek injunctive relief in court for misuse of intellectual property. The Federal Arbitration Act governs this section. Hearings may be held by video or phone or, if in person, in the county where you live.
• Public injunctive relief. Nothing in this section waives your right to seek public injunctive relief (relief whose main purpose is to stop unlawful acts that threaten future injury to the general public). Any claim for public injunctive relief will be decided by a court, not by an arbitrator, after any individual claims that are subject to arbitration have been arbitrated, and the court proceedings on that claim will be paused until then.
• Class-action waiver. YOU AND VOLUMATRIX EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable for a particular claim, that claim will proceed in court and not in arbitration.
• Jury waiver. If a claim proceeds in court, you and Volumatrix waive any right to a jury trial, where the law allows.
• Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@actual.love with the subject "Arbitration opt-out", your name and your account email. Opting out does not affect the rest of these Terms.
• Changes. If we change this section, the change applies only to claims arising after the change takes effect.

21. Changes and general terms#

• We may change the Service. We may update these Terms; for material changes we will tell you in the app or by email at least 14 days before they take effect. If you do not agree, you may cancel and delete your account before then.
• These Terms and the policies they refer to are the whole agreement between you and Volumatrix about the Service. If any part is unenforceable, the rest still applies. If we do not enforce something straight away, we have not given up the right to do so.
• You may not transfer these Terms. We may transfer them to an affiliate or to a successor in a merger or sale, and will tell you if we do.
• Copyright complaints: if you believe content on the Service infringes your copyright, send a notice meeting 17 U.S.C. § 512(c)(3) to support@actual.love. We close the accounts of repeat infringers.
